The introduction of the “Tech Talent Strategy” by Canada’s Minister of Immigration, Refugees and Citizenship Canada (IRCC) last month brought lots of good news for Start Up Visa (SUV) applicants including extending the work permit validity period from one year to three years, allowing for open work permits for individuals to work in Canada other than in their own businesses and also extending these perks to all the members of the SUV team rather than only for essential members. IRCC Minister Sean Fraser’s announcement is meant to alleviate situations of hardship for SUV applicants facing long processing times for their permanent residence applications and also enables Canadian employers to benefit from the skills of applicants already in Canada.

The BC Provincial Nominee Program (BC PNP) is operated by the provincial government of British Columbia in partnership with Immigration, Refugees and Citizenship Canada (IRCC) to address the labour market needs of the province. The program was originally established in 2001 and allows the province to nominate foreign workers, international students and entrepreneurs in British Columbia to apply for permanent residence through IRCC.
A popular pathway for immigration to Canada for business people is the Owner/Operator (“O/O”) Labour Market Impact Assessment (“LMIA”) category. Business persons seeking to purchase or establish a business under the O/O program could apply to Service Canada for an LMIA which would entitle them to apply for a work permit of up to two years. At the introduction of Canada’s Express Entry (“EE”) immigration selection program in January of 2015, the O/O LMIA became a popular immigration strategy for many business persons as it would qualify as Arranged Employment and garner 600 points in the EE scoring process and often lead to permanent residence for the O/O LMIA work permit holder.
