Humanitarian and Compassionate (“H&C”) applications are often the last resort for persons left with no other means of immigrating or remaining in Canada due to their personal circumstances. Under s.25(1) of the Immigration, Refugee and Protection Act (“IRPA”), H&C applications can be made from inside or outside Canada as an alternative to meeting the usual criteria for immigration. Individuals who are otherwise inadmissible to Canada may also be able to apply for special consideration based on H&C grounds.

In our immigration law office, we are regularly consulted by people who have been refused applications to Canada whether temporary or permanent, overseas or from within Canada. In most cases, we are able to succeed with a re-application.

Canada’s international student population continues to increase given that a Canadian education is one of the best ways to obtain that essential Canadian work experience to be able to qualify for PR in the future. But studying in Canada is not a guarantee that you will be able to remain permanently in Canada. Before commencing your studies in Canada, be sure that you fully understand all the steps in the process for studying, working and being able to qualify for permanent residence.
