Many people are aware of the humanitarian and compassionate (H and C) application process for permanent residence to Canada which people can turn to when they are not able to access any other type of immigration application and when they can demonstrate compelling personal circumstances. H and C applications can be made from within Canada as well as from outside of Canada. However, the H and C statutory provisions exclude certain applicants, specifically persons found to be inadmissible to Canada pursuant to ss. 34, 35 and 37 of the Immigration and Refugee Protection Act (IRPA) on security grounds. If you have been found inadmissible to Canada on one of these grounds what are your possible options to overcome such a finding and either remain in or come to Canada?

The question of how to sponsor your spouse who is already in Canada seems like a rather simple one. Indeed if you put that question to a CIC call centre representative, their answer is almost always as follows: "If your spouse is in Canada you use the Inland Spousal sponsorship category but if your spouse is outside of Canada, you use the Family Class category". As in most things to do with our Canadian immigration system, the answers to such questions are never that straightforward. Let's review the differences between the Family Class and the In-land Spousal categories.

The media was abuzz last week with several examples of people who had their citizenship applications rejected for failing to provide adequate proof of english language proficiency. The particular injustice highlighted in these refusals was that in these cases the individuals were born in the U.K. and had spent almost their entire lives in Canada pursuing their educations and careers in English in Canada yet had their applications refused for failing to provide acceptable proof of their language ability.
